Why is the rental agreement for 11 months and not 12?

In India, rental agreements for 12 months or more must be registered under the Registration Act, 1908, which involves stamp duty and registration fees. An 11-month agreement is exempt from compulsory registration, making it simpler and cheaper for both parties. It can be renewed after expiry.

What is the stamp duty for rental agreements in Tamil Nadu?

In Tamil Nadu, stamp duty for a rental agreement is 1% of (annual rent + security deposit). Registration is optional for agreements under 12 months. If you choose to register, an additional registration fee applies at the Sub-Registrar's Office.

Is a notarised rental agreement legally valid?

Yes — for 11-month agreements, notarisation (not registration) is sufficient and provides legal standing. However, for agreements of 12 months or more, registration is required for full legal enforceability.

What should a rental agreement include?

A valid rental agreement should include: names and addresses of landlord and tenant, property description, term and start/end dates, monthly rent and due date, security deposit amount and refund terms, notice period, permitted use (residential only), maintenance responsibilities, and signatures of both parties with witnesses.

What is a lock-in period?

The lock-in period is a minimum duration during which neither party can terminate the agreement. Typical lock-ins are 2–3 months. If the tenant vacates before the lock-in ends, they forfeit the security deposit (or part of it) as compensation.
